State legislature considers Competitive Workforce Act

The Florida state legislature will consider a bill to update current anti-discrimination laws. The bill, known as the Competitive Workforce Act, is currently being supported by bipartisan representatives in both the House and the Senate. The House version is Bill 45 and the Senate version is Bill 120.

Among other things, the bill would bring protections for lesbian, gay, bisexual and transgender individuals to the existing law. Those protections would extend into the workplace. Currently, the bill is reportedly backed by a number of state and national organizations, including at least nine businesses that are listed on the Fortune 500.

According to recent polls, the majority of Florida voters are likely to support such a measure. One poll, which included 600 Florida voters, indicated that 68 percent of participants would support adding legislation that included gender identity and sexual orientation as being protected from discrimination. On a national level, another poll suggests that 80 percent of business owners believe federal law should provide anti-discrimination protection for LGBT individuals.

One driver for increased diversity protections in the workplace could be the growing percentage of millennial workers. Younger workers, who are making up a growing percent of the overall labor force, place a high value on inclusion and diversity. Legal definitions for anti-discrimination with regard to gender identity and sexuality might also benefit companies, who are reportedly spending a great deal on discrimination issues. A March 2015 report indicated that in Florida alone, the total bill for LGBT discrimination was over $360 million in one year.
